Terms of Service

These Terms of Service ("Terms") govern your use of www.fitfoundercollective.com (the "Site") and any program, membership, coaching engagement, live session, or organization engagement offered by Fit Founder Collective ("FFC"), a brand of Evergreen Wellness Collective LLC, an Oregon limited liability company ("we," "us," "our").
By using the Site or purchasing any of our services, you agree to these Terms. If you do not agree, do not use the Site or our services.
1. Who may use our services
You must be at least 18 years old and able to form a binding contract. You agree that the information you give us is accurate and that you will keep it current.
2. What we provide
FFC provides fitness, performance, and business accountability programming. This includes cohort programs such as Founder 30, ongoing membership, 1:1 coaching, live experiences, and programming delivered inside organizations. We describe what is included at the point of purchase. We may improve or adjust the contents of a program over time, but we will not materially reduce what you paid for during a term you have already paid for.
We are not medical providers, therapists, or licensed financial advisors. Please read our Disclaimer, which forms part of these Terms.
3. Purchases, billing, and renewals
One-time programs. Cohort programs such as Founder 30 are charged once, in advance, for the stated period.
Membership. Membership is billed monthly in advance and renews automatically until you cancel. Founding rates remain in place for as long as your membership stays active without interruption.
Coaching. Coaching engagements are billed monthly in advance and carry the minimum term stated at the time you are accepted.
Payments are processed by our payment processor. Prices are in US dollars and exclude any taxes we are required to collect. If a payment fails we may suspend access until it is resolved.
4. Cancellation and refunds
Membership. You may cancel at any time from your account or by emailing us. Cancellation takes effect at the end of your current billing month. We do not pro-rate partial months.
Cohort programs. You may request a refund up to seven days before your cohort start date. Once a cohort has started, fees are non-refundable, because your seat is held and the programming is delivered from day one.
Coaching. Coaching is non-refundable for the current month. You may end the engagement with 30 days' notice after any minimum term has been met.
Live sessions. Paid session fees are refundable up to 48 hours before the session. If we cancel a session we refund it in full or move you to the next date, at your choice.
5. Your responsibilities in training
You are responsible for training safely, using appropriate loads, stopping when something hurts, and telling your coach about injuries, conditions, medications, or pregnancy that may affect your participation. In-person sessions require a signed waiver before you take part.
6. Community conduct
Our rooms and channels exist so founders can be honest about their work. You agree to keep what other members share confidential, to treat members with respect, and not to use FFC spaces to sell to other members without our written permission. We may remove anyone from a program, session, or channel for conduct that harms the room, without refund where the conduct is serious.
7. Intellectual property
All FFC programming, written materials, workouts, assessments, session content, and brand assets, including Brag Club, the Founder Performance Scorecard, Founder 30, and Founder 90, are our intellectual property. You may use them for your own personal use. You may not copy, resell, license, publish, or deliver them to others, including inside your own company or community, without a written agreement with us.
Anything you post in our community spaces stays yours. By posting it you allow us to display it inside those spaces. We ask separately, in writing, before we use anyone's name, words, or image in public marketing.
8. Photography and recording
We photograph and sometimes record our live sessions. We ask for written permission before publishing anyone's identifiable image or words. Tell us at the session if you would rather not appear, and we will keep you out of published material.
9. Organization engagements
Engagements with coworking spaces, accelerators, networks, and companies are governed by the written proposal and agreement we sign with that organization. Where those documents conflict with these Terms, the signed agreement controls for that engagement.
10. Disclaimers
The Site and our services are provided on an "as is" and "as available" basis. We do not warrant that the Site will be uninterrupted or error free. Results vary, and nothing we publish is a guarantee of any physical, financial, or business outcome.
11. Limitation of liability
To the fullest extent permitted by law, Evergreen Wellness Collective LLC, Fit Founder Collective, and our owners, coaches, staff, and contractors are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising out of your use of the Site or participation in our programs. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.
12. Indemnity
You agree to indemnify and hold us harmless from claims arising out of your breach of these Terms, your misuse of our materials, or your violation of any law or third-party right.
13. Governing law and disputes
These Terms are governed by the laws of the State of Oregon, without regard to conflict of law rules. Any dispute will be brought in the state or federal courts located in Multnomah County, Oregon, and you consent to that jurisdiction. Before filing, both sides agree to try to resolve the issue directly for 30 days.
14. Changes to these Terms
We may update these Terms. The date at the top reflects the current version. Material changes will be highlighted on the Site, and continued use after a change means you accept the updated Terms.
